PROFIFY USER CODE OF CONDUCT

By using the Profify platform, you acknowledge that you have read, understood, and agree to abide by this User Code of Conduct. This Code applies to all users of profify.ca, including students, tutors, coaches, and visitors.
Profify is a marketplace that connects students with tutors and coaches. We are committed to maintaining a safe, respectful, and professional environment for everyone on our platform. This Code of Conduct sets out the standards of behaviour we expect from all users.
1. GENERAL COMMITMENTS
By using the Profify platform, you agree to:
a. Comply with all applicable Canadian laws, including federal, provincial, and territorial legislation — including privacy laws (PIPEDA), intellectual property laws, anti-spam laws (CASL), consumer protection laws, and tax laws;
b. Provide accurate, complete, and up-to-date information to Profify, including your identity, qualifications, billing, and tax information as required by our Refund and Payment Policy;
c. Use the Profify platform in a lawful, honest, and professional manner;
d. Treat all other users — students, tutors, coaches, and Profify staff — with courtesy and respect;
e. Follow all standards of conduct set out in this document.
2. PROHIBITED CONDUCT
You agree that you will not, and will not authorize or facilitate any attempt by another person to, engage in any of the following:
PLATFORM INTEGRITY
1. Bypass the Profify platform to provide or receive tutoring or coaching services to/from users you met through Profify, or conduct sessions outside the platform to avoid Profify fees.
2. Solicit, accept, or encourage payments directly from students or tutors/coaches through any channel other than those provided by the Profify platform.
3. Manipulate pricing, listings, or availability in a way that interferes with other users' access to the Services.
4. Circumvent or manipulate the fee structure, billing process, or any fees owed to Profify or to a tutor/coach.
5. Fail to deliver confirmed sessions as a tutor/coach unless the failure was caused by the student or an unforeseeable circumstance beyond your control.
6. Schedule sessions without the student's knowledge and confirmed consent for the purpose of receiving payment.
7. Sell, resell, sublicense, rent, or otherwise provide access to the Profify platform to any third party without prior written authorization from Profify.
RESPECTFUL BEHAVIOUR
8. Harass, threaten, intimidate, bully, or cause distress to any user, person, or entity through the Profify platform.
9. Post or transmit content that is hateful, discriminatory, abusive, threatening, defamatory, obscene, pornographic, or otherwise objectionable. This includes content targeting individuals or groups on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or any other ground protected under the Canadian Human Rights Act or applicable provincial human rights legislation.
10. Use offensive, vulgar, or abusive language in any communication on the platform, including messages, reviews, profiles, or session content.
11. Exploit, solicit personal information from, or engage in any inappropriate conduct with minors (users under 18 years of age).
HONEST & ACCURATE INFORMATION
12. Post false, inaccurate, misleading, or fabricated information — including in your profile, qualifications, reviews, or any communications on the platform.
13. Impersonate any person or entity, or use another person's personally identifiable information (such as name, email address, or payment details) without their authorization.
14. Manipulate the ratings or reviews system — including posting fake reviews, incentivizing reviews, or pressuring users to modify or remove honest feedback.
15. Post User-generated content that infringes another party's copyright, trademark, trade secret, or other intellectual property rights.
PRIVACY & DATA
16. Disclose confidential or personal information obtained from another user or through your use of the Profify platform without their consent.
17. Harvest, scrape, or collect personal information about other users — including email addresses, phone numbers, or profiles — without their express consent.
18. Invade the privacy of any person, including posting private or personally identifying information about a person without their consent (or, in the case of a minor, without parental consent).
SECURITY & TECHNICAL INTEGRITY
19. Introduce viruses, malware, worms, Trojan horses, or any other harmful code to the Profify platform or its infrastructure.
20. Attempt to gain unauthorized access to any computer system, server, account, or data through the Profify platform.
21. Adapt, alter, reverse-engineer, decompile, or create derivative works from the Profify platform or its software without written authorization.
22. Transfer your Profify account, login credentials, or profile data to another party without Profify's written consent.
23. Send unsolicited bulk messages or engage in spamming behaviour through the platform's messaging tools, in violation of Canada's Anti-Spam Legislation (CASL).
COMMERCIAL & LEGAL BOUNDARIES
24. Use the Profify platform to advertise, promote, or sell goods or services unrelated to the tutoring or coaching services offered through the platform.
25. Promote, solicit, or participate in multi-level marketing, pyramid schemes, or other fraudulent commercial activities.
26. Engage in or promote the trafficking of persons, procurement of commercial sexual services, or use of forced labour in connection with any services offered on the platform.
27. Violate any applicable federal, provincial, territorial, or municipal law or regulation of Canada, or any applicable international law.
28. Encourage, facilitate, or participate in any conduct that would constitute a criminal or civil offence under Canadian law.
ACADEMIC & PROFESSIONAL INTEGRITY
29. Use Profify's services for the purpose of academic dishonesty — including hiring tutors or coaches to complete assignments, write papers, sit exams, or otherwise do academic work on your behalf.
30. Use the Services in a way that violates the academic integrity policies of your school, university, professional institution, or employer.
3. ENFORCEMENT & CONSEQUENCES
Profify reserves the right, in its sole discretion, to investigate any reported or suspected violation of this Code of Conduct. Depending on the nature and severity of the violation, Profify may take one or more of the following actions:
· Issue a formal warning to the user
· Temporarily suspend the user's account
· Permanently terminate the user's account, with or without prior notice
· Remove any content posted in violation of this Code
· Report the conduct to applicable Canadian law enforcement or regulatory authorities
· Pursue civil or legal remedies available under Canadian law
Profify is not obligated to provide refunds in cases where account suspension or termination results from a violation of this Code of Conduct.
4. REPORTING A VIOLATION
If you witness or experience behaviour on the Profify platform that you believe violates this Code of Conduct, please report it to us immediately at support@profify.ca. Include as much detail as possible — such as the username, date, and a description of the incident.
All reports will be reviewed by the Profify team. We are committed to taking appropriate action in a timely manner. Reports made in good faith will be treated confidentially to the extent possible.
5. AMENDMENTS
Profify may update this Code of Conduct from time to time to reflect changes in our platform, services, or applicable law. The latest version will always be available at profify.ca. Continued use of the platform after any update constitutes your acceptance of the revised Code.
